Military Dillema Under the “Usurper”

The Military face more of a perplexing situation in the days ahead about the question of Obama’s legitimacy, according to Tom Kovach, retired military. According to the Uniform Code of Military Justice, “honor” is the higher principle to be observed by the military, because they are sworn to uphold the Constitution. According to  Kovach  “it is also honor that causes a wise subordinate to — rarely, and with reasonable trepidation — rise up to disobey an order that is unlawful.
Kovach said “Many of the nuclear weapons, and nuclear-launch command posts, are protected by those that wear the Blue Beret…”

Rule 916 of the Manual for Courts-Martial (MCM), “Defenses”, especially subsections (c) and (d), makes clear that not only should a military member not be charged with a UCMJ offense for not obeying an unlawful order, but also that said military member does, indeed, have an “affirmative duty” to disobey an order that he knows — or, “that a person of ordinary sense and understanding would have known” — to be unlawful. The commentary of Rule 916 also cites Rule 801(e), stating that the question of whether the person giving the order was in a lawful position to give said order becomes an interlocutory question.”

Kovach further states that the Constitution was written in clear language by brilliant men who were specific in the meaning of what a “natural born citizen”. According to former military man, Colonel Gregory Hollister, Obama does not fit that definition, because he was born a British subject, by virtue of the British Nationality act of 1948, which made Obama a British subject because of his father.

So it is merely a question of time before the inner circle of “Blue Berets” start to question and object to the orders that might be given by the “Usurper”. Kovach calls it the Obama Oxymoron.

By the way, the blog entry that Tom posted about his concerns was already scrubbed by the fascist Obama team. According to Paul Hollrach the New Media Journal between 55-60% of the Public believe that the question of Obama’s eligibility has some merit. Mr Hollrach believes that the Supreme Court is waiting for a military challenge, for example, if Obama orders more troops into Afghanistan, and they refuse to go.

Just for an example of what he’s talking about, Kovach points to the movie “Crimson Tide, when the junior officer (Denzel Washington) bucks the orders of the Captain (Gene Hackman) to launch a nuclear strike:
